Following a request submitted by the Austrian Federal Competition Authority (AFCA) on 15 February 2022, the Cartel Court found an infringement of § 1 of the Cartel Act (KartG) on 13 May 2022.
Regel- und Steuersysteme AT GmbH had entered into a contract with R+S Group Regeltechnik und Schaltanlagenbau GmbH on 11 March 2019, which applied from 1 January 2019 until 10 February 2020, agreeing to divide the Austrian market for measurement and control technology for buildings by address of the relevant project and federal province and by specific customers.
The decision is final.
The company cooperated with the AFCA under the leniency programme (§ 11b of the Competition Act – WettbG), enabling the Authority to refrain from applying for a fine.
