Following a request submitted by the Austrian Federal Competition Authority (AFCA) on 15 February 2022, the Cartel Court imposed a fine of EUR 50,000 on R+S Group Regeltechnik und Schaltanlagenbau GmbH on 10 May 2022 for an infringement of § 1 of the Cartel Act (KartG).
The company had entered into a contract with Regel- und Steuersysteme AT GmbH on 11 March 2019, which was valid from 1 January 2019 until 10 February 2020, agreeing to divide the Austrian market for measurement and control technology for buildings by address of the relevant project and federal province and by specific customers.
The company has acknowledged the infringement to the AFCA, allowing the Authority to apply for a reduced fine.
The decision is final.
With regard to the other involved company, which cooperated with the AFCA under the leniency programme (§ 11b of the Competition Act – WettbG), the Cartel Court found an infringement of § 1 KartG (please see the press release).
