Fines

BWB can apply to the Cartel Court to impose fines.

Fines are limited to 10% of the overall turnover of the affected enterprise in the past business year in case of an offence against the ban on cartels, the abuse ban, the ban on retaliatory measures or the realisation ban as well as the disregard of obligations or commitments.

Fines of up to 1% of the annual turnover can be imposed in case of wrong or misleading information regarding a merger registration or a wrong or misleading answer to a request for information.

The calculation of the fine particularly takes into account the gravity and the duration of the law violation, the achieved enrichment of the offending party, the fault and the economic efficiency.
