Informal Assessment by the Austrian Federal Competition Authority on the Interpretation of Competition Law
It is possible to contact the AFCA in cases of uncertainty regarding the interpretation of competition law or merger control.
The objective — in the interest of prevention — is to support undertakings in complying with competition rules. The assessment is intended to serve as guidance for undertakings.
It should be noted that an informal assessment by the AFCA is not binding on other national or European authorities or courts. Changed circumstances or newly emerging findings may lead the AFCA to a different assessment.
Examples of recent assessments can be found in the Annual Report of the AFCA.

Questions regarding the notification requirement for mergers
If there is uncertainty as to whether a merger is subject to notification, the AFCA can be contacted via the following e-mail address:

Notification of a complex merger
If a merger appears to be particularly complex in advance, or if high market shares are expected following the merger, it may in many cases be advisable to hold a pre-notification meeting. Such a request should be submitted by e-mail to POST-praenotifikation[at]bwb.gv.at.
