Merger Notification - Announcement according to § 10 Cartel Act

On 02.09.2021 the Austrian Federal Competition Authority was notified of the following merger:
Planned purchase process
METRO Cash & Carry Österreich GmbH intends to acquire all the shares in, and sole control over, C & C Abholgroßmärkte Gesellschaft m.b.H. At the time of closing of the proposed transaction, C & C Abholgroßmärkte Gesellschaft m.b.H. will operate stores in Bludenz, Graz, Hartberg, Klagenfurt, Liezen, Neusiedl, Spittal an der Drau, St. Pölten, and Wiener Neustadt. As part of the proposed transaction, METRO Cash & Carry Österreich GmbH will also acquire real estate from the REWE Group that is currently used by C & C Abholgroßmärkte Gesellschaft m.b.H for those stores.
Industry sector: Wholesale of food, beverages and tobacco.

Deadline for bringing in an application pursuant to § 11(1) Cartel Act will end on 30.09.2021.
Entrepreneurs whose legal or economic interests are affected by the merger can bring in a written statement at the Federal Competition Authority or the Federal Cartel Prosecutor within 14 days from publication date.
Note: The intervening party has no right to a certain treatment of the statement and will not gain a party position.
