16.05.2014, Vienna. After a successful procedure in the period between 2012 and 2013, the Cartel Court once again (to 26 Kt 19/14) imposed a fine in the amount of EUR 290.000 against Swisspor, a business in the insulation industry. The sum of the imposed fine was therefore raised to EUR 1,425 Million. Swisspor cooperated with the national competition authority (BWB) and recognized the infringing behavior.
In the years 2006-2011, Swisspor was involved with infringing behavior in the sales of insulation materials, which not only showed vertical (price maintenance of the second hand with the retail market) but also horizontal elements (especially through the delivery of price lists between competitors).
In the year of 2011 the BWB completed a house search at the opponent's place of business and was able to secure evidence. However, the procedure has not ended with the mentioned decision, as other businesses are suspected of also being involved in the described agreements.
