After the analysis of the decision of KommAustria and several discussions with competitors, the BWB came to the conclusion to appeal the decision of KommAustria.
BWB: Remedies do not go far enough
KommAustria proposed remedies, which currently do not ensure competition and media diversity in this sector. In particular, the following additional measures or conditions seem necessary:
- Clear differentiation between the ORF and the new program
- Positioning as a niche channel by limiting the broadcasting of films and fictional program
- Greater restrictions for the marketing and advertising
