Cooperation and fine
Huber cooperated with the AFCA within the leniency programme to fully clarify the facts of the case, acknowledging the infringement for use in proceedings before the Cartel Court. The following circumstances were considered when setting the amount of the fine:
- The leniency recipient’s cooperation
- The subordinate role Huber played in the cartel
- The smaller number of acts directly infringing cartel law, compared with other involved companies
- Its low level of economic capacity
- Its lower share in the turnover in question, compared with other involved companies.
When setting the actual amount of the fine, the lower range applicable to smaller companies was considered, based on the comparably low level of turnover.
Infringements
Huber took part in illegal price fixing, market divisions and the exchange of sensitive information in relation to public and private tenders in the area of waste collection in Carinthia, spanning a period from at least 2003 until March 2021. The Huber infringements occurred in the context of an Austria-wide cartel that was in place from at least July 2002 until March 2021.
