Decision against the leniency applicant G4S Secure Solutions GmbH becomes final

At the request of the AFCA, the Cartel Court determined that G4S Secure Solutions GmbH (“G4S”) had participated in three tenders from non-public clients in the market for personnel security services.

G4S was involved in anti-competitive price fixing and price coordination and the exchange of information with a competitor in three tenders from non-public clients in the market for personnel security services. The infringement concerns the period from August 2019 to November 2022.

Leniency

G4S applied to the AFCA for leniency and subsequently fully cooperating with the AFCA to clarify the facts of the case. Based on the comprehensive cooperation under the leniency programme, the AFCA refrained from applying for the imposition of a fine and only requested that the Cartel Court finds an infringement.

Leniency programme and non-imposition of a fine

The AFCA may request a reduced fine or refrain from applying for the imposition of a fine for a company under leniency arrangements. Leniency will be granted if the company is actively helping to uncover a cartel. To this end, it is essential it cooperates truthfully, promptly and without restrictions.
