BASF SE; Vattenfall Hollandse Kust Zuid 1&2 C.V.; Vattenfall Hollandse Kust Zuid 3&4 C.V.

On 13.07.2021 the Austrian Federal Competition Authority was notified of the following merger:

Planned purchase process

BASF SE, intends to indirectly acquire 100% of the shares in Nehalennia 5 B.V., Nehalennia 6 B.V., Nehalennia 11 B.V. and Nehalennia 12 B.V., as well as 49% of the shares in Hollandse Kust Zuid 1&2 B.V. and Hollandse Kust Zuid 3&4, and will indirectly hold 49,49% in Vattenfall Hollandse Kust Zuid 1&2 C.V. and Vattenfall Hollandse Kust Zuid 3&4.

Affected industries: Electricity generation and trade

Deadline for bringing in an application pursuant to § 11(1) Cartel Act will end on 10.08.2021.

Entrepreneurs whose legal or economic interests are affected by the merger can bring in a written statement at the Federal Competition Authority or the Federal Cartel Prosecutor within 14 days from publication date.

Note: The intervening party has no right to a certain treatment of the statement and will not gain a party position.

Withdrawal of the Merger Application: The Applicant withdrew the Merger Application on 23.07.2021.
