Merger Notification - Announcement according to § 10 Cartel Act

On 05.08.2025 the Austrian Federal Competition Authority was notified of the following merger:
Planned purchase process
Schütz GmbH & Co. KGaA, Selters, Germany, intends to acquire all of the shares of Euro-Composites S.A., Echternach, Luxembourg.
C - MANUFACTURING C 22 - Manufacture of rubber and plastic products, C 22.2 - Manufacture of plastic products, C 22.21 - Manufacture of plastic plates, sheets, tubes and profiles
Deadline for bringing in an application pursuant to § 11(1) Cartel Act will end on 16.09.2025.
Entrepreneurs whose legal or economic interests are affected by the merger can bring in a written statement at the Federal Competition Authority or the Federal Cartel Prosecutor within 14 days from publication date.
Note: The intervening party has no right to a certain treatment of the statement and will not gain a party position.
On August the 25th 2025 the applicant requested the extension of the deadline for the submission of an application for examination by two weeks, pursuant to § 11 (1a) Cartel Act. The deadline for the submission of an application for examinations by the administrative authorities is extended by two weeks, thus ending on Septmber the 16th 2025.

Non-prohibition of the merger
The Federal Competition Authority and the Federal Cartel Prosecutor have not applied for examination of the merger by the Cartel Court. The standstill obligation (§ 17 (1) Cartel Act) ends with effect from 17.09.2025 .
