On 23.05.2025 the Austrian Federal Competition Authority was notified of the following merger:
Planned purchase process
METRO FSD Holding GmbH, based in Düsseldorf, Germany, intends to acquire 100% of the shares in and control of the GVS Group. The GSV Group comprises the following seven companies: Huster Consult GmbH, GVS Lebensmittelhandel Verwaltungs GmbH, GVS Lebensmittelhandel GmbH & Co Handelsgesellschaft KG, romac Logistik und Service GmbH, GVS Süd GmbH & Co. KG and GVS Logistik GmbH & Co. KG, each based in Nuremberg, and GVS Nord GmbH & Co. KG based in Hamm.
Business sectors affected: Supply of system catering, regional markets for pick-up and delivery wholesalers and food logistics for third-party customers; Wholesale of food, beverages and tobacco; Wholesale trade services of food, beverages and tobacco, Wholesale of ceramic, glassware and cleaning products.

Deadline for bringing in an application pursuant to § 11(1) Cartel Act will end on 20.06.2025.
Entrepreneurs whose legal or economic interests are affected by the merger can bring in a written statement at the Federal Competition Authority or the Federal Cartel Prosecutor within 14 days from publication date.
Note: The intervening party has no right to a certain treatment of the statement and will not gain a party position.
Non-prohibition of the merger
The Federal Competition Authority and the Federal Cartel Prosecutor have not applied for examination of the merger by the Cartel Court. The standstill obligation (§ 17 (1) Cartel Act) ends with effect from 21.06.2025 .
