Merger Notification - Announcement according to § 10 Cartel Act

On 13.05.2025 the Austrian Federal Competition Authority was notified of the following merger:
Planned purchase process
Subject to the notified merger pursuant to § 7 Abs 1 Z 3 KartG is the acquisition of 65% of the shares in AMT-Tayel HandelsgmbH, FN 269233 g, by SAATBAU ERNTEGUT GmbH, FN 89167 d.
Economic sectors concerned: Post-harvest crop activities and seed processing for propagation; Wholesale of grain, unmanufactured tobacco, seeds and animal feeds; Wholesale of fruit and vegetables; Wholesale of coffee, tea, cocoa and spices
A - AGRICULTURE, FORESTRY AND FISHING A 01 - Crop and animal production, hunting and related service activities, A 01.6 - Support activities to agriculture and post-harvest crop activities, A 01.63 - Post-harvest crop activities and seed processing for propagation, G - WHOLESALE AND RETAIL TRADE, G 46 - Wholesale trade, G 46.2 - Wholesale of agricultural raw materials and live animals, G 46.21 - Wholesale of grain, unmanufactured tobacco, seeds and animal feeds, G 46.3 - Wholesale of food, beverages and tobacco, G 46.31 - Wholesale of fruit and vegetables, G 46.37 - Wholesale of coffee, tea, cocoa and spices
Deadline for bringing in an application pursuant to § 11(1) Cartel Act will end on 10.06.2025.
Entrepreneurs whose legal or economic interests are affected by the merger can bring in a written statement at the Federal Competition Authority or the Federal Cartel Prosecutor within 14 days from publication date.
Note: The intervening party has no right to a certain treatment of the statement and will not gain a party position.
Non-prohibition of the merger
The Federal Competition Authority and the Federal Cartel Prosecutor have not applied for examination of the merger by the Cartel Court. The standstill obligation (§ 17 (1) Cartel Act) ends with effect from 11.06.2025 .
