On 17.02.2025 the Austrian Federal Competition Authority was notified of the following merger:
Planned purchase process
Louis Dreyfus Company Suisse S.A. intends to indirectly acquire one entity (Grünau Illertissen GmbH) and certain assets related to the BASF Group's food performance ingredients, health ingredients, protein hydrolysates and conjugated linoleic acid businesses, specifically all shares in Grünau Illertissen GmbH, certain assets of BASF Personal Care & Nutrition GmbH, certain IP rights and trademarks of Cognis IP Management GmbH, BASF SE and other BASF entities, and certain assets (primarily imventories and contracts) and employees ofnumerous global BASF entities.
C - MANUFACTURING C 20 - Manufacture of chemicals and chemical products, C 20.5 - Manufacture of other chemical products, C 20.59 - Manufacture of other chemical products n.e.c.
Deadline for bringing in an application pursuant to § 11(1) Cartel Act will end on 17.03.2025.
Entrepreneurs whose legal or economic interests are affected by the merger can bring in a written statement at the Federal Competition Authority or the Federal Cartel Prosecutor within 14 days from publication date.
Note: The intervening party has no right to a certain treatment of the statement and will not gain a party position.
Non-prohibition of the merger
The Federal Competition Authority and the Federal Cartel Prosecutor have not applied for examination of the merger by the Cartel Court. The standstill obligation (§ 17 (1) Cartel Act) ends with effect from 18.03.2025 .
