MERINDA 47 Entwicklungs GmbH; Quatra Projektentwicklungs GmbH; STRABAG Real Estate GmbH

On 22.07.2022 the Austrian Federal Competition Authority was notified of the following merger:

Planned purchase process

As a first step MERINDA 47 Entwicklungs GmbH, FN 577550p ("MERINDA 47") with its registered office in 4020 Linz, Grillparzerstrasse 18-20 intends to acquire 60% of the shares in Quatra Projektentwicklungs GmbH, FN 275656b ("QUATRA") with its registered office in A-4020 Linz, Römerstraße 2 (see confidential appendix ./1.1). Subsequently, the remaining business share is to be taken over. By taking control of QUATRA, MERINDA 47 will indirectly acquire joint control of the subsidiaries of QUATRA (see para 1.2.7). QUATRA shares control with STRABAG Real Estate GmbH. QUATRA and STRABAG Real Estate GmbH intend to jointly develop a new urban quarter in Linz, the so-called "Franckviertel".

Deadline for bringing in an application pursuant to § 11(1) Cartel Act will end on 19.08.2022.

Entrepreneurs whose legal or economic interests are affected by the merger can bring in a written statement at the Federal Competition Authority or the Federal Cartel Prosecutor within 14 days from publication date.

Note: The intervening party has no right to a certain treatment of the statement and will not gain a party position.
