On 14 June 2019 the Cartel Court, at the Federal Cartel Prosecutor’s request, imposed a fine of € 70,000 on WIG Wietersdorfer Holding GmbH.
WIG Wietersdorfer Holding GmbH had acquired a 50% stake in the target company Calcit, proizvodnja kalcitnih polnil d.o.o., Stahovica, Slovenia, on 6 June 2018, thus assuming joint control. This acquisition constituted a merger subject to notification requirements. However, it was only officially approved in accordance with merger law on 15 January 2019. This means that a breach of the standstill obligation occurred during the period between 6 June 2018 and 15 January 2019. The target company operates in the building materials industry.
The company did not contest the decision. The decision is final.
