23.05.2014, Vienna. The Cartel Court (to 26 Kt 19/14) imposed a fine on the 07.05.2014
(to 27 Kt 22/14) in the amount of EUR 225.000 against the AFS Franchise system GmbH, due to vertical agreements with beer and beverage suppliers. The parties waived on appeal. The decision complies the national competition authority's request.
The anticompetitive behavior affected certain brewery products and non-alcoholic beverages in the period between 2005 and 2013. In the context of these vertical price agreement measures, Kurant prices and especially promotional prices were coordinated between the AFS franchise system Ltd and the beer and beverage suppliers. These resale prices were transposed in many cases. With search warrants approved by the court, the cartel court proceedings went ahead with a house search.
