Merger Notification - Announcement according to § 10 Cartel Act

On 19.01.2021 the Austrian Federal Competition Authority was notified of the following merger:
Planned purchase process
Recticel SA/NV (Brussels/Belgium) and its – indirectly wholly owned – subsidiary Recticel Dämmsysteme GmbH (Königswinter/Germany) intend to acquire all shares in and sole control over FoamPartner Switzerland AG (Wolfhausen/Switzerland) and the German entities FoamPartner Germany GmbH (Duderstadt/ Germany), FoamPartner Leverkusen GmbH (Leverkusen/ Germany), FoamPartner Delmenhorst GmbH (Delmenhorst/ Germany) and FoamPartner Converting Center GmbH (Duderstadt/Germany).
The intended concentration concerns the manufacture and distribution of PU foam products.
Industry sector: C - Verarbeitendes Gewerbe/Herstellung von Waren
Deadline for bringing in an application pursuant to § 11(1) Cartel Act will end on 02.03.2021.
Entrepreneurs whose legal or economic interests are affected by the merger can bring in a written statement at the Federal Competition Authority or the Federal Cartel Prosecutor within 14 days from publication date.
Note: The intervening party has no right to a certain treatment of the statement and will not gain a party position.
On 12.02.2021 the applicant requested the extension of the deadline for the submission of an application for examination by two weeks, pursuant to § 11 (1a) Cartel Act. The deadline for the submission of an application for examinations by the administrative authorities is extended by two weeks, thus ending on 02.03.2021.
Withdrawal of the Merger Application: The Applicant withdrew the Merger Application on 26.02.2021.
