Construction cartel: PORR acknowledges infringement – AFCA to ask Cartel Court for EUR 62.35 million fine

In the course of settlement talks with the Austrian Federal Competition Authority (AFCA) involving the Federal Cartel Prosecutor, PORR AG (PORR) acknowledged its infringement, thereby committing itself to pay a fine of EUR 62.35 million for concerted practices in the construction industry.

The AFCA will file a corresponding application for imposition of the fine with the Cartel Court.

Investigations conducted by AFCA to date

In spring 2017, the AFCA carried out dawn raids as part of its investigation into alleged concerted practices among construction companies, in the course of which it also impounded large amounts of data.

In autumn 2019, the AFCA submitted its initial statement of objections to the companies concerned. A statement of objections is a formal step in AFCA investigations informing the parties concerned in writing of the objections raised against them. Investigations into numerous other companies involved are ongoing, and will lead to further applications in due course.
