BWB against deceptive sweepstakes "Friedrich Müller"

By order of 23 March 2011 (4 Ob to 6/11b), the Supreme Court dismissed an extraordinary appeal of G.N.V. Naturprodukte Versand GmbH and its managing director Gerhard Bruckberger.

The Supreme Court confirmed legally BWB`s application for issuance of an interim injunction, which had been brought in according to § 7 VBKG (Consumer Authorities Cooperation Act). The decision confirms that events using the brands "Friedrich Müller" and "Paraholding" in Germany and France are prohibited, as they are misleading sweepstakes.

These sweepstakes give consumers the false impression that he or she had already won, will win, although the prospect of the prize will be raffled among all senders and divided evenly.

BWB as the competent Austrian Authority according to VBKG acted on the request of the  German and French Consumer Protection Authorities, which a large number of complaints had been received in.
