On 28.12.2023 the Austrian Federal Competition Authority was notified of the following merger:

Planned purchase process

The Innsbrucker Kommunalbetriebe Aktiengesellschaft, Salurnerstraße 11, A-6020 Innsbruck, FN 90981x (hereinafter referred to as "IKB"), the Abwasserverband Achental - Inntal - Zillertal, Strass im Zillertal 150, A-6261 Strass i.Z., corporation under public law pursuant to Article 87 WRG 1959 (hereinafter referred to as "AIZ"), the Abwasserverband Hall in Tirol – Fritzens, Innstraße 12, A-6122 Fritzens, corporation under public law pursuant to Article 87 WRG 1959 (hereinafter referred to as "AVHF") and the Abwasserverband Wörgl-Kirchbichl und Umgebung, Klärwerkstraße 1, A-6322 Kirchbichl, a corporation under public law pursuant to Article 87 WRG 1959 (hereinafter referred to as "AVWK") shall establish a limited liability company (hereinafter referred to as "company") for the utilisation of sewage sludge with its registered office in Innsbruck.

The object of the company shall be, in particular, the planning and construction of a sewage sludge incineration plant and the utilisation of the heat generated thereby. The incineration process also produces sewage sludge ash, which in turn is disposed of by the company. It is intended that full operation can begin at the end of 2032.

The ÖNACE codes of the company are as follows: (Treatment and disposal of non-hazardous waste)

The ÖNACE codes for the business activities of IKB are as follows: electricity distribution, water supply, electricity generation, sewage disposal, funeral services, collection of non-hazardous waste, swimming pools and stadiums, solariums, saunas, spas n.e.c., wired telecommunications.

The ÖNACE codes for the business activities of the other parties involved are wastewater disposal.

Industry sector: D - Energieversorgung E - Wasserversorgung; Abwasser- und Abfallentsorgung und Beseitigung von Umweltverschmutzungen, J - Information und Kommunikation, R - Kunst, Unterhaltung und Erholung, S - Erbringung von sonstigen Dienstleistungen

Deadline for bringing in an application pursuant to § 11(1) Cartel Act will end on 25.01.2024.

Entrepreneurs whose legal or economic interests are affected by the merger can bring in a written statement at the Federal Competition Authority or the Federal Cartel Prosecutor within 14 days from publication date.

Note: The intervening party has no right to a certain treatment of the statement and will not gain a party position.
