BWB/K-337 Decision private brewery Zwettl

13.02.2014, Vienna. The Cartel Court imposed a fine on the 29.01.2014 (25 Kt 153/13) in the amount of EUR 82.500 against the private brewery Zwettl Karl Schwarz GmbH, due to vertical agreements with the grocery retail. The decision complies with the national competition authority's request.

13.02.2014, Vienna.  The Cartel Court imposed a fine on the 29.01.2014 (25 Kt 153/13) in the amount of EUR 82.500 against the private brewery Zwettl Karl Schwarz GmbH, due to vertical agreements with the grocery retail. The decision complies with the national competition authority's request.

The anticompetitive behavior affected the influence on final selling prices of certain brewery products in the period between 2007 and 2011. In the context of these vertical price agreement measures, Kurant prices and especially promotional prices were coordinated between the private brewery Zwettl Karl Schwarz GmbH and the grocery retail. These resale prices were, in some cases, transposed by the retail market.

As the parties waived on appeal, the Cartel Court's decision is legally binding. With court house search warrants, the antitrust court proceedings went ahead with a house search.
